BY – LAW #2007 – 1553

 

BEING A BY-LAW to License Trailers in the Township

 

WHEREAS the Municipal Act, 2001 Section 168   authorizes the Municipality to pass by-laws for the licensing of Trailers in the Municipality.

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF STRONG DOES HEREBY ENACT AS FOLLOWS:

 

1.      Definitions:

 

  1. Corporation shall mean the Corporation of the Township of Strong
  2. Municipality shall mean the lands within the corporate limits of the Township of Strong
  3. Trailer shall mean any vehicle constructed to be attached and propelled by a motor vehicle and that is capable of being used by persons for living, sleeping or eating, even if the vehicle is jacked up or that its running gear is removed. For the purpose of this by-law “trailer” shall not include any trailer when located within the township for the purpose of sale or storage.

 

 

2.      Prohibition

 

a.       No Person shall use, or locate a trailer within the Municipality for 30 days or longer in any year except in a trailer camp operated or licensed by the Municipality, unless such person has first obtained a license therefore under the provisions of this by-law

 

  1. No owner of land shall permit a person to use, or locate a trailer on the land of the owner within the Municipality for 30 days or longer in any year, unless such person has first obtained a license, therefore under the provisions of this by-law

 

  1. All applications for such license shall be made in the prescribed form attached to this by-law and the applicant shall pay a license fee of $20 per month, in advance, for every month or portion of a month that the trailer is to be located in the municipality.  No license fee shall be charged in respect of a trailer assessed under the Assessment Act.

 

  1. After the first year, and when a Land Fill Card is purchased, an Annual Trailer License fee of $120 is due and payable by July 31st each and every year the Trailer is on the property.   Every license obtained under this paragraph shall expire on the 31st of December in the year for which it was issued.

 

  1. No trailer for which a licence is required under this By-law shall be located on land except in conformity with the set back requirements for a dwelling unit as prescribed by the Corporation of the Township of Strong Zoning By-law 93-1307, as amended, for the zone in which the lands are located.

 

3.      General

 

a.       No License shall be issued under this by-law if the application for license or the proposed undertaking by the applicant would be in contravention of any other by-law of the Corporation or of any Federal or Provincial Law or Regulation.

  1. Any License issued under this by-law is not transferable.
  2. All license fees shall constitute a debt owing to the Corporation.

 

4.      Penalty

 

Any Person who contravenes  or fails to comply with any of the provisions of this by-law shall be guilty of an offence and shall be liable to the fine and penalties prescribed by the Provincial Offences Act.  Each day of contravention shall constitute a separate offence.

5.      Validity

 

If any provision of this by-law is for any reason declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the by-law as a whole, or any part thereof other than the provision so declared to be invalid and it is hereby declared to be the intention that all the remaining provisions of this by-law shall continue to be in full force and effect until repealed, notwithstanding that one or more provisions thereof shall have been declared to be invalid.

 

6.      Effective Date – This by-law shall come into effect on the  1st day of  January, 2008.

 

By-law #2004 - 1489 is hereby repealed.
